EPC's
Since the 1st October 2008 it has been a legal requirement, under the Energy Performance of Buildings Regulation Act, that all commercial buildings will require an Energy Performance Certificate (EPC) on sale, rental or upon construction.
What is an EPC?
EPCs are part of a European Directive to improve energy efficiency and lessen carbon emissions from a property. An assessor undertakes an onsite survey to capture information, including construction details, glazing, activity, heating/cooling systems, ventilation and lighting etc. this information is recorded and the property’s energy performance rating is calculated, this rating is on a scale from A-G as shown on the provided image.
Once assessed, suggestions for improvements will be made which could lead to lower energy usage. The more energy efficient the property, the more attractive it could be to potential tenants.
Does every property need an EPC?
The law applies to all commercial buildings that are conditioned either by heating or cooling. Certain rules apply for the production of EPCs where only a part of a building is being marketed.
How often do I have to have an EPC assessment?
An EPC lasts for 10 years and can be re-used by future tenants within this 10 year period.
What happens if I don’t apply for an EPC?
Failure to comply with these regulations can result in fines which are calculated at 12.5% of the rateable value of the building, these fines could be up to a maximum fee of £5000.
If an EPC is not produced for the letting/sale of a property, this could jeopardise the sale!
Who is responsible for obtaining an EPC?
The vendor or landlord of the property that is being marketed.
The law requires an EPC to be made available to prospective buyers or tenants of commercial premises at the earliest opportunity, and no later than when any written information is requested, or; when a viewing is conducted and/or, in any event, before entering into a contract to sell or rent.
